Terms and Conditions

§1 General Provision

1.1 The terms and conditions are valid for competitions announced by cirp GmbH. purmundus challenge is a registered trademark of cirp GmbH, represented by CEO Dipl.-Kfm. Ralf-D. Nachreiner and Dipl.-Kfm. Petra Nachreiner, Römerstr. 8, 71296 Heimsheim, Germany. E-Mail: challenge@purmundus.de. Mannheim District Court HRB 705890, VAT no.: DE 173 714 842. All goods and services of purmundus challenge are solely based on the following terms and conditions valid at the time of participation.
1.2 These terms and conditions are valid regardless of any differing terms and conditions of participants and cooperation partners.
1.3 Participants are required to fulfill all conditions specified in the competition announcement. The announcement is available for download on the website www.challenge-purmundus.com/en/Registration.php.
1.4 Any right of retention and set-off shall only be acknowledged if it is uncontested or has been determined in a final judgement by a court of law. purmundus challenge shall be eligible to set off any claims that purmundus challenge has against a participant against any claims the participant has against purmundus challenge.
§2 Participants

2.1 The competition "purmundus challenge" of the current year is intended creative types who break new ground in the field of 3D and 4D printing.
2.2 Any participant needs to be the original creator of the design. The design needs to be the participant's intellectual property. The participant needs to hold all and exclusive property rights and exclusive temporal and spatial rights of use. A representative may be appointed by designating a particular person, or arranged organisationally by the function of deputy.
2.3 purmundus challenge reserves the right to decide about eligibility based on the submission, and to broaden the range of those eligible for the competition, where appropriate. Please refer to the respective tender documents. purmundus challenge does not censor any submissions.
2.4 Pending or subsequently physical models are returned. Any accruing costs for return of model and bear any risk of shipping shall cover by participant. Any submitted data, like data carriers and documents, will not be returned. If a participant explicitly wishes for his/her documents to be sent back, he/she shall cover any accruing costs for return and bear any risk of shipping.
§3 Registration and Conclusion of Agreement

3.1 The participant shall submit the registration form together with the required documents, data and designs at purmundus challenge. For the deadline, please refer to the tender documents. The post/e-mail stamp shall be authoritative. Any registrations and designs sent in after the deadline will not be eligible. There is no right of appeal.
3.2 Languages of the competition are German and English.
3.3 Every participant is allowed to hand in as many as 3 designs.
3.4 Submissions can be made by individuals or groups, provided that one of the team members is named as contact.
3.5 By sending the registration form, the participant agrees with the terms and conditions of participation.
3.6 The agreement between the participant and purmundus challenge is concluded by purmundus challenge sending an online confirmation of acceptance into the competition. Please mention the participant's number specified therein in any further correspondence.
§4 Costs and Conditions of Payment

4.1 Arranging and organising of competitions causes costs for purmundus challenge.
4.2 Participation is free of cost.
4.3 Participants shall bear the costs for developing their submitted drafts and for their submission and return, including for the security of shipping as well as the exhibition risk.
4.4 The purmundus challenge shall bear the expenses for exhibitor insurance and stand monitoring.
4.5 There will be no additional costs arising for participants for any publications in the aftermath of the competition.
§ 5 Jury

5.1 The international, independent Jury will be composed of professionals of the fields of design, research, economy, teaching, and industry.
5.2 The submissions will be revised and evaluated in a non-public process.
5.3 In case a member of the jury is involved directly in a submission, his/her vote will be omitted for this submission.
5.4 The evaluation criterions are:
The jury is free to weigh the different criterions. If the submitted designs fit the requirements of the criterions, they will be chosen and honored. Besides the labelling for the first prizes the jury is free to choose additional designs to be shown in the exhibition.
5.5 The jury's vote is legally valid and does not need to be justified. There is no censure by purmundus challenge. There is no right of appeal.
§6 Awards and Prizes

6.1 The winner will be presented at the Formnext of the current year during the award ceremony.
6.2 The winner will receive a trophy of the purmundus challenge. The prize endowment of the purmundus challenge of the current year is available on https://www.purmundus-challenge.com/en/Preise.php.
§7 Public Relations and Communications

7.1 The purmundus challenge finalists of the current year will be exhibited at the Formnext of the current year. The award ceremony of the best finalists and for the audience prize will be held at the Formnext of the current year. The finalists will receive their certificates and the winners will get their trophy. The specimens can be used by the recipients for their own exhibition or PR purposes, but without any commercial use.
7.2 The results of the competition will be communicated by purmundus challenge during the Formnext of the current year and through press information. Special interest media will receive press material containing pictures and texts by purmundus challenge. The finalists will be presented in a flyer. purmundus challenge has the copyright for this flyer. Upon consultation, it might be reproduced.
7.3 The participant concedes the right of usage and right of publication of the submitted designs to purmundus challenge and purmundus challenge' cooperation partners for the time of the competition, and for publications and exhibitions related to the competition. Commercial use is excluded. All participants agree to that upon registration. The winners can use the award without limitations in terms of time for their own communication purposes. The trademark purmundus challenge will continue to exhibit the award-winning designs at future exhibitions, if that fits into the concept of the respective presentation.
§8 Reservations

8.1 The trademark purmundus challenge reserves the right to cancel the competition in case purmundus challenge judges the viability of the contest to be not secured. In the same way, other important reasons (like force majeure, cancellation of cooperation partners) might lead to the postponing or cancelling of the event.
8.2 In case the event is only postponed, the agreement remains valid. If the event is cancelled, all obligations of the contract partners cease to exist, no claims to cost reimbursement and to compensation will be accepted. There is no right of appeal.
§9 Withdrawal

9.1 Within 14 days the participant can withdraw his/her registration via email or letter (in writing). Later than that, a withdrawal from the competition is excluded, as the jury will have started the selection process by that time and the assessment of the submitted designs is in process.
9.2 Any data submitted, like data carriers and documents, will not be returned. If a participant explicitly wishes for his/her documents to be sent back, he/she shall cover any accruing costs for return and bear any risk of shipping. In addition, pending or subsequently physical models are returned. Any accruing costs for return of model and bear any risk of shipping shall cover by participant.
§10 Rights

10.1 The copy rights of any design remains with the participant. The participant concedes the right of usage and right of publication of the submitted designs to purmundus challenge and purmundus challenge' cooperation partners for the time of the competition, and for publications and exhibitions related to the competition. Commercial use is excluded.
10.2 The participant testifies and guarantees that by submitting designs he/she does not violate any property rights or copyrights of any third party in any way. In case of a claimed violation of property or copy rights, the participant releases purmundus challenge, the cooperation partners and jury members from any claims, and reimburses purmundus for the accrued damage and costs.
10.3 purmundus challenge and the jury members reserve the right to deny an award in case violations of rights of third parties should be proofed. The participant accepts these conditions by signing the registration form or submitting the online registration form. Printable, producible data is necessary for participation in the competition. The data carriers will not be returned.
§11 Secrecy/Non-Disclosure

11.1 The information about the submitted designs for the contest is confidential. During the evaluation period and until October of the current year the purmundus challenge team, the cooperation partners and the members of the jury commit not to reveal or disclose any confidential information.
11.2 This agreement shall be terminated once the list of Finalists of the current year is published and applies for the submitted designs that will be presented, exhibited and awarded.
§12 Place of Performance and Place of Jurisdiction

12.1 Exclusive place of performance and place of jurisdiction for the agreement is the principle office of purmundus challenge; this is also the case if the participant has his/her place of residence abroad.
12.2 As soon as purmundus challenge comes to know through a final judgement or a court order about any violation of rights of third parties by any participating design, the respective participant can be excluded from the competition or the award can be denied.
12.3 All claims shall be made in writing.
§13 Severability Clause

The invalidity or partial invalidity of any of the aforementioned provisions does not affect the validity of any other provisions and of the agreement as a whole. An invalid or partially invalid provision shall be replaced by that valid provision which is closest to the economic purpose of the invalid or partially invalid provision.
In case of wrong translation the German GTC are valid.
